Asset of Community Value or not?
ACVs can often be hugely complex. They cause a great deal of anxiety for all involved. At its heart is the power to enable a community the right to buy somebody else’s property.
We have been working with Cornerstone Barristers to resolve whether a former pub should be designated, again, as an ACV and with success.
Key sentence “… the Council does not consider there to be sufficient evidence in the application that the land or building can continue to further the social interests of the community.”
Because of the sensitivity of the case, whilst we may have prevailed and persuaded the Authority not to call it an ACV, these matters rumble on through the submission of planning. And in this case, Listed Building Consent (LBC) applications.
This is a small step forward in the right direction for Benchmark’s clients.
